HIV+ Idaho Man Faces Life In Prison For Deliberately Infecting Others
Kerry Thomas, 45, has been to prison twice for deliberately infecting others with the human immunodeficiency virus (HIV), and now he’s out again on parole. This concerns the Ada County, Idaho, deputy prosecutor enough that she’s filed charges with the county’s grand jury to put him behind bars for the rest of his life.
Thomas faces life in prison this time as a ‘persistent violator,’ an accusation based on his criminal history.
In 1990, Thomas was found guilty of two counts of statutory rape and was sentenced to 12 years in prison. He served only three years before getting released on parole. That time, the original charges also included four counts of knowingly transmitting HIV but these charges were dropped as part of a plea bargain.
In 1996, Thomas was once again in the court room, this time facing one charge of knowingly transmitting HIV. He was again convicted, this time to 15 years but had to serve only seven years of that sentence.
Thomas is once again out of prison on parole but Jean Fischer, the Ada County deputy prosecutor, initiated an indictment against him as a persistent violator and is seeking a life sentence against him.
Although charged, Thomas is not yet in custody.
